Some people belive that there should be fixed punishments for each type of crime. Others, however, argue that the circumstances of an individual crime, and the motivation for commiting it, should always be taken into account when deciding on the punishment.

Discuss both views and give you own opinion.

In last decade amount of crime has risen significantly bringing some arguable issue regarding to the punishment. Some people think that punishment imposed by government should be implemented equivalent to all sorts of crimes. In contrast, other people argue that it will stimulate criminalist as a consequence the society will suffer. In my opinion retribution is set by legal authority should not be permanent.

From one point of view, it is frequently asserted that harsh penalty is set by government reduce amount of crime. It is no doubt true that the fixed punishment will result increase unruly behavior of people, motivating criminal activity. In additional, this type of structure will result dissatisfaction of society and people will rebel against government.

On other hand, today majority of government authority set penalty according to the weight of crime committed by people; thus it will be unfair if punishment will be equal to all sort of crime. However, the punishment of murdering human being should not be the same with those who committed crime by stealing anything because of his/her personal needs.

Personally, I believe that fixed punishment imposed by government has negative externalities on both – social and economic side. However, most of countries are eager to avoid criminal activities to preserve its global reputation. It is undeniable fact that fixed punishment will stimulate crime as a result social stability will be destroyed.

In conclusion, in order to preserve just society the judicial branches of government should apply progressive criminal law. Moreover, fixed punishment system is not best way to balance justice in society.
